Court Marriage registration in Nepal
Marriage is considered when a man and a woman recognize one other as husband and wife; they do so through a celebration, ceremony, formal or other gathering. Marriage can also be seen of as an agreement between people of opposite sex.
Court Marriage is considered to be a legal marriage. In Nepal Court marriage has been stated in Muluki Civil Code, 2074 BS. As per this Code, Marriage is required to be registered in the District Court by signing legal papers in front of the Judge.
An application can be submitted with the District Court in their respective District. The legislation stipulates that either the man or the woman, or both, must have spent at least 15 days in the District where the application is being filed. If both the parties live outside of Nepal then in that case they can apply at the nearest Nepali Embassy or Consulate and they must show that they have spent at least 15 days in the country where the application is being filed.
- Man and woman must accept each other as husband and wife.
- A married couple must not be blood relatives in order to be punished for incest. However, the law has made an exception for the caste (tribe) when marrying one's relatives is culturally permitted.
- Both the man and the woman must be unmarried or divorced.
- Both the male and the woman must be at least 20 years old.
Documents required for Court Marriage in Nepal:
- Both husband and wife are required to submit citizenship
- Both side parents are required to submit citizenship
- Citizenship of both sides witnesses
- Passport size photo of both husband and wife
- If they are registering in a temporary address, then a letter from the permanent residence's ward office is required.
- Consensus paper in the prescribed format prepared by Attorney.
- An attorney prepares a duly filled and signed application form in the prescribed format.
- For temporary residence, a letter of recommendation from the local ward office is required. This is only required if the application is being filed in a District other than the one where the party's permanent residence is located.
- The Local Government is required to issue a recommendation letter for being unmarried or single status. Such letter is required for both husband and wife from their respective ward office.
As a court fee, a bank voucher equivalent to Rs. 500 is required.
- Passport of the Parties
- Citizenship of parents of the Parties
- Visa issued by the Government of Nepal
- Passport size photo of the Parties
- No objection letter from the concerned Embassy in Nepal or from Government authority of foreign country. The Document issued by foreign Government authority is required to be attested by the competent authority and translated in Nepali Language and attested by Notary Public.
